THE WISDOM OF ASKING SUPREME COURT JUSTICE STEPHEN BREYER TO STEP DOWN TO ENSURE TRANSITION TO A LIBERAL JUSTICE
Liberals fear that the 6-3 Supreme Court conservative-leaning majority could grow worse if a liberal justice should pass on, and the seat is filled with a conservative justice. Such was the case with Ruth Bader Guinsberg. To guard against a 7-2 conservative-leaning court, many are asking Justice Breyer to retire (early) to prevent against this. And this strategy is part-and-parcel of another plan to address the purported imbalance by increasing the number of justices, known as "court packing" with liberal jurists. Brian Fallon of Demand Justice, Rep. Mondaire Jones, Rep. Jerome Nadler, both of New York , and Justice Breyer weigh in.
